Termination Of Agreement:

Cheap.com.au may terminate this Agreement without notice to the merchant in any of the following circumstances:


a. The Merchant or its representative uses advertising on behalf of the Cheap.com.au that has not been authorised by Cheap.com.au

b. The Merchant or its representative is involved in any advertising practices that are false or misleading.

c. The Merchant or its representative is involved in any dishonest practices including willful misrepresentation of items listed.

d. The Merchant or its representative creates any hyperlinks, references or redirections to any content or anywhere without written authorisation from Cheap.com.au.

e. Cheap.com.au determines that the merchant is no longer acting in the best interests of Cheap.com.au


The Parties shall seek to settle any dispute arising in connection with this Agreement by negotiation, mediation and conciliation between the parties.

Should an issue / complaint be unable to be resolved, both parties shall agree in writing that the Agreement shall be dissolved, effective from that date.


ENFORCEABILITY

If any of the provisions contained in this Agreement judicially is held to be void or otherwise unenforceable, in whole or in part, the Parties agree to be bound by all other provisions of the Agreement.


ASSIGNMENT

The Merchant may not assign or otherwise transfer or delegate any right or duty without Cheap.com.au expresses written consent. The Merchant will not have the authority to contract for or incur obligations on behalf of Cheap.com.au
